2. Processing of personal data
a) When visiting our website
When you visit our website www.encore-efficiency.de, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted:

The legal grounds for data processing is Art. 6 Para. 1 Sentence 1 lit. f GDPR. Our legitimate interest is derived from the data collection purposes listed above. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person. Moreover, we use cookies and third-party services and content when you visit our website. You can find more detailed explanations about this under sections 4 and 5 of this data protection declaration.

Whenever you contact us by e-mail, by telephone or by post, the data you provide (e.g. your e-mail address, name and telephone number) is processed by us in order to handle your request and answer your questions. We delete the data that is generated in this context once storage is no longer necessary, or restrict processing if there are legal obligations to retain data. The legal grounds for this data processing is Art. 6 Para. 1 Sentence 1 lit. f GDPR. Our legitimate interest is derived from the purpose of processing your request and answering your questions. If the processing of your personal data is necessary for pre-contractual measures or for the fulfillment of a contract, Art. 6 (1) lit. b GDPR serves as the legal grounds.

3. Forwarding of data
We do not forward your personal data to third parties for purposes other than those listed below. We only share your personal data with third parties if:

• you have given your express consent to this in accordance with Art. 6 (1) p. 1 lit. a GDPR,

• the disclosure is necessary in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,

• in the event that there is a legal obligation for the disclosure pursuant to Art. 6 Para. 1 Sentence 1 lit. c GDPR, as well as 

• such sharing is legally permissible and necessary according to Art. 6 Para. 1 Sentence 1 lit. b GDPR for the processing of contractual relationships with you.

4. Cookies on our website
We use cookies on our website. Cookies are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. You have the right

• to request information about your personal data that is processed by us in accordance with Art. 15 of the GDPR. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;

• in accordance with Art. 16 of the GDPR, to demand the immediate correction of inaccurate or incomplete personal data that we have stored about you;

• pursuant to Art. 17 GDPR, to request the deletion of your personal data that we have stored, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the assertion, exercise or defense of legal claims;

• in accordance with Art. 18 GDPR, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 GDPR;

• in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller;

• in accordance with Art. 7 (3) of the GDPR, to revoke your consent given to us at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future; and

• to complain to a supervisory authority in accordance with Article 77 of the GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our registered office for this purpose.

7. Objection to or withdrawal of consent to the processing of your data
If you have granted consent to the processing of your data, you may withdraw this consent at any time in accordance with Article 7 (3) of the GDPR. Such a withdrawal affects the permissibility of the processing of your personal data after you have expressed it to us.

This website uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, this includes requests that you send to us. An encrypted connection can be recognized by the fact that the address line of the browser changes from http:// to https:// and by the lock symbol in your browser line.
We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in accordance with technological developments.

9. Data deletion and storage period
Your personal data will be deleted or blocked as soon as the original purpose for storing it no longer applies. The data we process will be deleted or its processing restricted in accordance with Articles 17 and 18 of the GDPR. Unless expressly stated otherwise within the scope of this data protection declaration, the data we have stored will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. This data protection declaration is currently valid and has the status July 2022.
Due to the further development of our website and offers on it or due to changed legal or regulatory requirements, it may become necessary to change this data protection declaration.
